Exacaster UAB (“Exacaster,” “we,” “us” or “our”) values your privacy and is committed to protecting your personal information. Exacaster is a big data predictive analytics technology company developing advanced machine-learning algorithms and software platforms that address key sales and marketing challenges including churn or usage prediction, product recommendations, segmentation and real time dynamic pricing.

In this Privacy Policy (“Policy”), we describe the information that we collect from visitors to our Site. This Policy applies to our website, www.exacaster.com (the “Site”), and all services that we offer or make available through the Site (the “Services”). By using any of our Services or visiting our Site, you agree that your personal information will be handled as described in this Policy.

What Information Do We Collect About You and Why?

The information we collect from you allows you to use our Services and helps us to provide our Services to you, send you information or content in which you may be interested, and keep you abreast of any updates related to our Services. We also use this information to personalize and continually improve our Site and our Services. Here are the types of information we gather:

Information We Collect Directly From You. Certain areas and features of our Site are available to you without registration or the need to provide us with any information. However, other features of the Site may require registration, and we will request that you provide your name and contact information, such as your phone number email address and organization to which you belong.

What About Cookies and Other Tracking Mechanisms?

We use cookies or other tracking mechanisms to track information, as described above, about your use of our Site. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable their web browsers ability to accept cookies will be able to browse the Site; however, some Site features may not function if you disable cookies.

Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear gifs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site to, among other things, track the activities of website visitors, help us manage content, and compile statistics about website usage. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Site Analytics. As noted, we use Google Analytics to evaluate usage of our Site. We also may use other analytic means to evaluate our Site. We use these tools to help us improve our Site, performance and user experiences.

How Do We Use Your Information?

We use the information that we gather about you for the following purposes:

When and How Does Exacaster Share Information It Receives?

Exacaster is an open network. This means that any information you post to our Site may be available not only to all other Exacaster users, but also to all visitors to our Site.

We do not sell or rent our users’ personally identifiable information. As discussed in this Policy and described below, we may share your information, including personally identifiable information, with other Exacaster users; third parties for marketing purposes; and to assist us in operating our Site and providing our Services.

Exacaster Users. Your username and any information that you post to our Site, including, without limitation, product reviews, comments, and text will be available to all other Exacaster users. This information also will be searchable by all Exacaster users.

Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personally identifiable information will be subject to this Policy.

Third Parties. We may share your information with third parties to assist us in our marketing efforts.

Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions on our behalf. These third parties have agreed to maintain the confidentiality, security and integrity of personally identifiable information and to only use such information for the purposes for which they have been engaged by us.

Business Transfers: If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from to the acquiring company.

In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.

To Protect Exacaster and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, or violations of our Terms of Use or this Policy.

Aggregate and Anonymized Information. We may share aggregate or anonymized information about users with third parties for marketing, advertising, research or similar purposes. For example, if we display advertisements on behalf of a third party on our Site, we may share aggregate, demographic information with that third party about the users to whom we displayed the advertisements.

User Generated Content

As stated above, our Site is an open network, and any information that you submit to the Site may be viewable by all users of our Site and all visitors to our Site. Users may submit their own content to the Site, including text and product reviews. Exacaster is not responsible for the privacy of any information that you choose to submit through this Site, our Services or through any public forum, such as a blog, or for the accuracy of any information contained in those postings. Any information that you disclose becomes public information. We cannot prevent such information from being used in a manner that may violate this Policy, the law, or your personal privacy.

Exacaster also is not responsible for the accuracy of any information that is submitted by users on our Site.

Third-Party Links

Our Site contains links to other third-party websites. Any access to and use of such linked websites is not governed by this Policy, but, instead, is governed by the privacy policies of those third-party websites, and we are not responsible for the information practices of such third-party websites.

How Secure Is Information About Me?

We have implemented commercially reasonable precautions, including, where appropriate, password protection, encryption, SSL, firewalls, and internal restrictions on who may access data to protect our Site and the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security all of the time.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a password that nobody else knows or can easily guess, and keeping your password private. Also, you should never share your log-in information with others. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Can I Access and Modify My Personal Information?

You may modify any personal information that you have submitted by re-registering with the updated information, or by submitting an update request via phone, e-mail or mail at the contact information listed in the section on “How to Contact Us About Privacy” below. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time.

What Choices Do I Have?

We send periodic emails to interested users regarding various promotions or other information that we believe may be of interest to our users. If we send you any news and newsletters, special offers, promotions or other information we think may interest you, you may tell us to stop sending you such e-mail communications by following the opt-out instructions contained in any such e-mail. Please note that it may take up to 10 days for us to process opt-out requests. Further, if you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.

Children Under 13

Our Services are not designed for children under 13. We do not knowingly collect information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.

Consent to Transfer Information to the European Union

If you are located outside of the European Union, please note that information we collect will be transferred to and processed in the European Union. By using our Site or Services, you consent to the transfer and processing of your information in the European Union. Your consent is voluntary. If, however, you do not consent, then we may not be able to provide you with our Services.
